Membership Agreement

1. Ratification of the Agreement

Users can become members of Heryerbitki.com by filling out a user registration form or through social media network memberships (Facebook, Twitter, Pinterest, etc.) via Heryerbitki.com or websites accessible through this address. Every Heryerbitki.com user agrees and undertakes to comply with the terms of this User Agreement ("Agreement") entered into with AG SÜS BİTKİLERİ SAN . VE TİC . A.Ş. (“ heryerbitki.com ”).

2. Services

Heryerbitki.com offers its users the opportunity to order food from registered businesses and other related services through applications that can be developed for the internet, mobile phones, smart TV systems, or similar platforms.

3. Heryerbitki.com User System

  • Every Heryerbitki.com user will have a "username" or email address and a "password" that they choose themselves.
  • “Usernames,” like email addresses, are unique to each member, and the same username will not be assigned to multiple members.
  • To access systems requiring Heryerbitki.com membership, each user must enter their username or registered email address and password. This process is defined as logging into the Heryerbitki.com system. Users may also log in to other sites included in the Heryerbitki.com system using the same username or email address and password they used to log in to Heryerbitki.com, provided they agree to the relevant user agreements.
  • The "password" is known only to the relevant user. If the user forgets their password, Heryerbitki.com will, upon request, send a link to the email address registered in the Heryerbitki.com system to create a new password. The user is solely responsible for setting and protecting their password, and Heryerbitki.com is not liable for any problems or damages arising from password usage.
  • Heryerbitki.com will be able to inform its users via email about promotions available in the regions where their registered addresses are located, as well as about new services or projects within the Heryerbitki.com system. Furthermore, Heryerbitki.com may reach its users through all communication channels they share with the Heryerbitki.com system, including social media channels, and share various promotions, campaigns, and similar information.
  • The name, address, and phone number registered by users on Heryerbitki.com will be shared with the merchant delivering the order to ensure faster and more accurate delivery.
  • Heryerbitki.com is in no way responsible for any problems or damages that may arise between the user and the merchant due to the sharing of the name, address, and telephone number registered in the system with the merchant delivering the order.
  • Heryerbitki.com owns all intellectual property rights to the data and information generated through the use of its system. Heryerbitki.com may use this information to create reports containing demographic data without disclosing user membership information, or it may use such information or reports itself and share these reports and/or statistics with business partners and third parties, with or without charge. These actions do not constitute a violation of the Heryerbitki.com Privacy Policy.

4. User Responsibilities

While the user is using Heryerbitki.com services,

  • The user acknowledges that the information provided in the registration form is accurate, that only one email address can be assigned to each username created on Www.Heryerbitki.com, that the assigned email address cannot be changed, and that a new email address can only be assigned when a new user is created on Heryerbitki.com; that the user accepts responsibility for any damages to themselves or third parties arising from inaccurate or incomplete information (such as forgetting a password) in cases where this information is required, and that in such cases, their Heryerbitki.com membership may be terminated;
  • The user acknowledges that they are solely responsible for all actions taken using their "username" or registered email address;
  • Copyright of the services and software provided by Heryerbitki.com belongs to www.heryerbitki.com that it belongs to them and that they will not reproduce or distribute these software programs in any way;
  • By using Heryerbitki.com services, the user acknowledges that they are responsible for their personal opinions, thoughts, and expressions, as well as the files and personal information they upload to the Heryerbitki.com platform. Heryerbitki cannot be held liable in any way for these files, including but not limited to disputes that may arise between the member business and the user. Heryerbitki is free to publish or not publish these opinions and thoughts, and also reserves the right to edit these opinions and comments through moderators and correct spelling errors.
  • Heryerbitki.com The services provided by Heryerbitki may contain content intended for individuals over the age of 18 in some cases, and Heryerbitki will not be held responsible for any unlawful viewing of such content.
  • Heryerbitki.com Heryerbitki will not be held responsible for any information, messages, or files that are lost, received incompletely, or sent to the wrong address during the use of its services;
  • You agree not to access the services offered on Heryerbitki.com in any way other than that determined by Heryerbitki.com and/or without authorization, not to modify the software in any way, not to use any software that appears to have been modified, and to compensate Heryerbitki for all material and moral damages it may suffer in case of non-compliance with these rules;
  • In accordance with the Regulation on the Procedures and Principles Regarding the Sale and Presentation of Tobacco Products and Alcoholic Beverages and related legislation, Heryerbitki.com strictly prohibits the sale of tobacco products and alcoholic beverages. Users are advised not to obtain tobacco products and alcoholic beverages through Heryerbitki.com or make requests to member businesses in this regard; any actions to the contrary may result in the cancellation of membership and termination of this Agreement.
  • Heryerbitki cannot be held responsible for any damages that may arise from the unauthorized reading or use of user data;
  • Heryerbitki will not be held responsible for any damages that may arise from the unauthorized use, sharing, or publication of user content by third parties;
  • Users shall refrain from using usernames, photos, and nicknames that are threatening, immoral, racist, contrary to the laws of the Republic of Turkey and international agreements, contain political messages, or infringe upon the intellectual or industrial property rights of third parties; and shall refrain from sending messages or comments that are of a nature that violates these laws.
  • Usernames, photos, correspondence, subject headings, and nicknames to be added to the platform must comply with general moral, ethical, and legal rules; must not contain political messages; and all financial rights listed in the Law on Intellectual and Artistic Works No. 5846 dated 5.12.1951, including all rights of publication, processing, reproduction, dissemination, representation, transmission to the public by means of signs, sounds and/or images, transfer and assignment to third parties, related to the said expressions, correspondence, and photos, are transferred to Www.Heryerbitki.com;
  • Not to harass or threaten other users;
  • We agree not to behave in a way that would negatively affect other users' use of the Heryerbitki.com system;
  • The user agrees not to misuse the services offered on the Heryerbitki.com system or any systems and applications developed in connection with it, and not to engage in any behavior that infringes upon or harms the rights of other users of this system. The user acknowledges that they are solely responsible for all damages that Heryerbitki or the user may suffer as a result of such misuse, and that if such misuse is detected, AG Süs Bitkileri reserves the right to close or limit the user's account or parts of their account such as username, profile picture, etc., or to terminate their Heryerbitki membership.
  • Not to publish, print, reproduce, or distribute any material or information that is defamatory, offensive, immoral, inappropriate, or unlawful, or that tarnishes the names of individuals or institutions;
  • Not to advertise, sell or offer to sell any goods or services, or engage in surveys, contests, or chain letter activities;
  • Do not send information or programs that could damage information or software on other users' computers;
  • The user acknowledges that any records or materials obtained using Heryerbitki.com services are entirely with their consent, that they are solely responsible for any malfunctions, data loss, and other losses they may cause on their computer, and that they will not claim compensation from Heryerbitki for any damages they may suffer as a result of using the Heryerbitki.com system.
  • Without obtaining permission from Heryerbitki, you agree not to use Heryerbitki.com services for commercial or advertising purposes;
  • Heryerbitki can monitor the entire system at any time or continuously;
  • If a user violates the rules, Heryerbitki reserves the right to take necessary action, including removing them from the service and terminating their membership.
  • Heryerbitki can use its system for commercial purposes;
  • I refrain from transmitting information that is prohibited by law and from sharing data that I am not authorized to send, such as chain mail or software viruses (etc.);
  • Not to record, disseminate, or misuse personal information belonging to others;
  • If payment is not made via the online payment method, the customer is required to pay the previously communicated service fee using the chosen payment method upon delivery of the order; otherwise, the product may not be delivered to them.
  • Heryerbitki.com declares, undertakes, and accepts that the system uses cookies, that cookies are pieces of information that a website transfers to a cookie file on the user's computer's hard drive, that these enable users to browse Www.Heryerbitki.com, and that they help in preparing content tailored to the needs of users accessing the site when necessary.

5. Permissions Granted to www.heryebitki.com

  • Heryerbitki.com may temporarily suspend or completely shut down the system at any time. Heryerbitki.com may also temporarily suspend or completely stop users from making payments via the Online Payment Method due to user actions that raise security concerns. Heryerbitki.com will not be liable to its users or third parties for any temporary suspension or complete cessation of the system or the use of the Online Payment Method. Username or email and password will be displayed and confirmed after completing the application fields provided by Heryerbitki.com. Heryerbitki.com reserves the right to permanently block members who have completed the user registration form or users who have logged into the Heryerbitki.com system from obtaining a new password or using their existing password. Heryerbitki.com will take the necessary care to ensure that its services are provided in a timely, secure, and error-free manner, that the results obtained from the use of the services are accurate and reliable, and that the quality of the services meets expectations, but it does not guarantee these. Heryerbitki.com has the right to back up and delete some or all of the files and messages that users will have in the environment during their use of the system at periods it deems appropriate. Heryerbitki.com will not be held responsible for backup and deletion processes. Heryerbitki.com owns the intellectual property rights and copyrights arising from the information, documents, software, designs, graphics, etc. that it produces and/or purchases from external sources. Sales in the Heryerbitki.com system are limited to the availability of member merchant menus at the time of ordering. Heryerbitki.com may not be able to deliver products that are not available at the relevant member merchant to the user. The display of products on the Heryerbitki.com system does not mean that they are in stock. Heryerbitki.com reserves the right to publish, process, share on social media networks, and/or move to another address deemed appropriate by Heryerbitki.com, or remove from the website at its discretion, any information, documents, software, designs, graphics, etc., created and uploaded to the system by its users (e.g., user images, messages added to the board, poems, news, files, etc.) in any written and visual medium. It is possible that this published information may be copied, processed, and/or published by other users. In such cases, the user will not claim any copyright fees from Heryerbitki.com. The responsibility for changing the price and product specifications of products offered for sale on the Heryerbitki.com system belongs to the member businesses on the Heryerbitki.com system. If errors occur in price or product specification information, Heryerbitki.com will inform users and may correct the error by delivering the product or canceling the order. Heryerbitki.com will take the necessary care to ensure that accurate and honest descriptions are provided regarding the content of the products offered for sale on the Heryerbitki.com system; however, Heryerbitki.com is not responsible for problems or damages arising from incomplete and/or incorrect descriptions made by member businesses regarding order contents. Heryerbitki.com may provide users with links to websites outside the Heryerbitki.com system. In this case, the user acknowledges in advance that Heryerbitki.com is not responsible for the content of the sites they will be redirected to. Heryerbitki.com may, in time, convert services that do not require user membership into services that do require membership, open additional services, partially or completely change some of its services, or convert them to paid services. In this case, the user reserves the right to terminate the Agreement and withdraw from membership. Heryerbitki.com may make changes to the application of this Agreement, modify existing clauses, or add new clauses in the future due to technical necessities and compliance with legislation, provided that these changes are not to the detriment of users. Heryerbitki.com is not responsible for the content provided by member dealers.

6. Intended Use

Users acknowledge that all orders and purchases made through the Heryerbitki.com system are for personal use only and are not intended for resale.

7. Payment

Heryerbitki.com users can pay for their orders placed through the Heryerbitki.com system upon delivery, using the payment method they selected from the options offered by the relevant merchant on the Heryerbitki.com system during the ordering process. Users can also make instant online payments using bank cards, credit cards, or similar payment methods via other payment systems (e.g., PayPal) using the Online Payment Method. In cases where payments made using the Online Payment Method are used illegally by someone other than the cardholder, the transaction will be processed according to the provisions of the Bank Cards and Credit Cards Law No. 5464 dated 23.02.2006 and the Regulation on Bank Cards and Credit Cards published in the Official Gazette No. 26458 dated 10.03.2007. For orders paid for using the Online Payment Method, the receipt/invoice for the order will be issued by the merchant who received the order, not by Heryerbitki.com. For orders placed using the Online Payment Method, Heryerbitki.com is exclusively authorized by the dealers to collect payments for the ordered products from the Users on behalf of the dealers. Users fulfill their payment obligations by making the payment to www.Heryerbitki.com for orders placed using the Online Payment Method. For orders placed using the Valet Service, including but not limited to online payment, credit card/debit card payment on delivery, and cash on delivery, Heryerbitki.com is exclusively authorized to collect payments for the ordered products from the Users on behalf of the dealers. Users fulfill their payment obligations to the dealer and www.Heryerbitki.com by making the payment for orders placed using the Valet Service, including but not limited to online payment, credit card/debit card payment on delivery, and cash on delivery.

8. Personal Data

By registering on www.Heryerbitki.com, the user acknowledges and declares that they explicitly consent to the processing and transfer of their personal data ("Personal Data"), such as name, surname, email address, order address(es), and telephone number, shared with Heryerbitki, the data controller, during their activities on the Website after membership, in accordance with the principles set forth in the Law on the Protection of Personal Data, and to its transfer to third parties and abroad. The processing and transfer of Personal Data to third parties and abroad are based on the legal relationship established between the User and Heryerbitki.com. Personal Data may be processed by Heryerbitki.com and its affiliates within the scope of this contractual relationship, and by Heryerbitki.com and its affiliates' business partners with whom they have a contractual relationship, for purposes such as marketing, analysis, and statistics, transferred to third parties and abroad, or used in an anonymized form. In addition, Users acknowledge and declare that they explicitly consent to the recording, processing, listing, and/or anonymizing of their order information (such as the dealers they ordered from, the type of product ordered, the quantity ordered, the time of ordering, the region where the order was placed, and all their behavior on the Website (or similar mobile or electronic platform used), order details, etc.) and similar data ("Data") by Heryerbitki.com, Heryerbitki.com affiliates and business partners, and to their use in an anonymous manner for analysis with third parties to better provide the service or to enable the operation of various applications or programs on Heryerbitki.com.

10. Product Delivery

If the user is not at the address they selected on the Heryerbitki.com system during the product delivery process by member businesses, the order will absolutely not be left at another address. In this context, the user must accept the legal liabilities that will arise from placing an order to an address where they are not present.

11. Refund

Refunds will only be issued to users for orders paid for using the online payment method.

  • The order was compulsorily cancelled because the user's address was outside the delivery area of the retailer from whom the order was placed;
  • The order was cancelled due to the inability to forward it to the relevant dealer.
  • Order cancellation upon user request in cases where the order has not been prepared by the dealer or, even if the order has been prepared, the dealer has approved the cancellation;
  • Compulsory partial or complete cancellation of the order due to part or all of the order being unavailable at the retailer;
  • Order cancellation due to dissatisfaction with the ordered product, following approval from the relevant dealer; and
  • In the event of a delay in delivery of the ordered product, cancellation will be processed upon approval by the relevant dealer. If the dealer has issued a receipt or invoice for the cancelled order and this has been delivered to the customer, it must be returned to the dealer's representative.


Heryerbitki.com reserves the right not to issue refunds solely for reasons attributable to the user (e.g., the user not being home, providing incorrect address information, or failing to receive the order).
For orders paid using payment methods other than online payment, refunds are processed directly by Heryerbitki's affiliated merchants. Heryerbitki.com accepts no responsibility for any disputes that may arise regarding the product return conditions set by its affiliated merchants.

12. Retention of Information and Burden of Proof:

User information, orders, comments/reviews, etc. registered in the Heryerbitki.com system will be stored for at least three (3) years, subject to the Heryerbitki.com Privacy Policy. In any dispute arising from the performance of this Agreement, the data and user records stored in the Heryerbitki.com system shall constitute binding and conclusive evidence. This Agreement is subject to the laws of the Republic of Turkey. The Istanbul Central Courts and Enforcement Offices shall have jurisdiction in resolving any disputes that may arise from the performance of this Agreement.

14. Entry into force

This Agreement shall enter into force between the parties for an indefinite period from the moment the user completes the user registration form.

15. Termination

The parties may terminate this Agreement at any time. The termination of this Agreement shall not affect the parties' claims against each other.
